Notice of Proposed Rulemaking amending 14 NYCRR Part 578
(Medical Assistance Rates of Payment for Residential Treatment Facilities for Children and Youth)

• To freeze rates paid to providers for 7/1/11-6/30/12 and amend methodology regarding pharmaceutical costs incurred during the first 90 days after admission.

Notice of Proposed Rulemaking amending 14 NYCRR Part 588
(Medical Assistance Payment for Outpatient Programs)

• To implement the 1.1% Medicaid rate reduction for the operating rate of Continuing Day Treatment Programs consistent with the 2011-2012 State budget.

Notice of Proposed Rulemaking amending 14 NYCRR Part 599
(Clinic Treatment Programs)

• To provide clarification, make minor program modifications, amend provisions regarding payment for certain off-site services, and add requirements regarding implementation of Behavioral Health Organizations.

(Operation of Psychiatric Inpatient Units of General Hospitals)

• To prohibit commingling of children and adults receiving services in groups – consistent with non-discretionary statutory requirements.

(Operation of Licensed Housing Programs for Children and Adolescents and Operation of Residential Programs for Adults)

• To add standards pertaining to the use of carbon monoxide detectors – consistent with non-discretionary statutory requirements.

• To update and clarify the expectations of OMH regarding ACT programs, including reimbursement standards.
